CocoBuddy Terms of Use

1. Agreement

These Terms of Use are an agreement between you and Chin and Cheeks LLC, a California limited liability company, for the CocoBuddy iOS app. By downloading, installing, or using CocoBuddy, you agree to these Terms and to our Privacy Policy, which is part of this agreement.

If you do not agree to these Terms, please do not use the app.

2. The service, and who may use it

CocoBuddy is a conversation journal for families. It's built for parents and guardians to use together with their kids: a parent operates the account, chooses what gets recorded, and manages the family's settings.

An account is optional. You can use CocoBuddy without signing in. An account is needed only if you want to back up and sync your family's content across devices, or to make identity-tied purchases like CocoBuddy Premium.

3. Your family's content

Your family owns the recordings and transcripts you create in CocoBuddy. We don't claim ownership of any of it.

To make the app work, we need your permission for the basics: storing your recordings, transcribing them on your device, backing them up to your account when you sign in, and playing them back. We never use your family's content for advertising, and we never use it to train machine learning models.

When you delete a recording or your account, our license to that content ends.

4. Free tier and purchases

Every account can save up to 5 memories for free (deleting one frees up a slot). The limit only affects whether you can save a new recording. It never affects your access to memories you've already saved.

CocoBuddy Premium removes the free-tier limit. It's offered as an auto-renewing annual subscription and as a one-time lifetime purchase. Prices are shown in the App Store at the time of purchase.

If you subscribe to the annual plan, payment will be charged to your Apple Account. Your subscription renews automatically unless you cancel at least 24 hours before the current period ends. You can manage or cancel your subscription in your App Store subscription settings. Refunds are handled by Apple according to its own policies. If you've made a purchase before, you can restore it from within the app.

5. Acceptable use

Use CocoBuddy lawfully and in good faith. If you record someone else's voice, do so only with their knowledge and consent where required. Don't abuse, disrupt, or attempt to misuse the service.

6. App Store terms

Because you downloaded CocoBuddy from the Apple App Store, the following terms also apply. Where anything in this section conflicts with another part of these Terms, this section controls for App Store users.

1. This agreement is between you and Chin and Cheeks LLC only, not Apple, and Apple is not responsible for the app or its content. Chin and Cheeks LLC, not Apple, is solely responsible for CocoBuddy and these Terms.
2. You are granted a non-transferable license to use CocoBuddy on any Apple-branded device that you own or control, as permitted by the App Store's Usage Rules, including access through Family Sharing where available.
3. Chin and Cheeks LLC, not Apple, is responsible for providing any maintenance and support for CocoBuddy. Apple has no obligation whatsoever to furnish any maintenance or support for the app.
4. If CocoBuddy fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to CocoBuddy, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Chin and Cheeks LLC's responsibility alone.
5. Chin and Cheeks LLC, not Apple, is responsible for addressing any claims relating to CocoBuddy or your use of it, including product liability claims, any claim that CocoBuddy fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar law.
6. In the event of any third-party claim that CocoBuddy or your possession and use of it infringes that third party's intellectual property rights, Chin and Cheeks LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
7. You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
8. The developer of CocoBuddy is Chin and Cheeks LLC. Questions, complaints, or claims about the app should be directed to support@cocobuddy.app.
9. You must comply with any applicable third-party agreements when using CocoBuddy, such as your wireless data service agreement.
10. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of them.

7. Termination

You can stop using CocoBuddy at any time, and delete your account from within the app whenever you'd like. We may also suspend or end your access if you violate these Terms.

What happens to your data when your account ends is covered in our Privacy Policy, in the section on your choices and deletion.

8. Disclaimers and limitation of liability

CocoBuddy is provided "as is." We do our best to keep it working well, but we can't promise it will always be error-free or uninterrupted. To the extent permitted by law, Chin and Cheeks LLC is not liable for indirect, incidental, or consequential damages arising from your use of the app.

9. Governing law, changes, and contact

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

We may update these Terms from time to time as the app changes. When we do, we'll update the "Last updated" date at the top of this page.
